SMS INBOX TERMS OF SERVICE

These Terms govern your use of the SMS Inbox service (“Service”) provided by Authentic8, Inc. (“Authentic8,” “we,” or “us”). By accessing or using the Service, you agree to be bound by these Terms, in addition to the Authentic8 Terms of Service located at https://www.authentic8.com/terms-of-service, which are hereby incorporated by reference. If there is any conflict between these Terms and the main Terms of Service, these Terms control with respect to the SMS Inbox and integrated email account components.

1. Service Overview. The Service provides communications utilities designed to support secure research and authentication workflows. Depending on configuration, the Service may include:

  • A virtual phone number (10-digit long code or “10-DLC”) capable of receiving Short Message Service (“SMS”) messages;
  • A dedicated email account provisioned under a customer-specific domain;
  • A recovery email account provided to each customer organization for internal account recovery and continuity in the event of lockout or credential loss;
  • An administrative account retained by Authentic8, used solely for email provisioning and emergency purposes, under SOP and restricted access controls. 

Note: ‘Provisioning’ is limited to the initial configuration of the email tenant and the programmatic addition, disabling, or removal of individual user accounts.

As part of the Service, Authentic8 manages inbound SMS message handling and supporting telephony infrastructure, which may include Subscriber Identity Modules (SIMs), end-user devices, and messaging applications required to enable SMS delivery and receipt. Such management is limited to operating the Service and does not constitute telecommunications services to the public.

2. Customer Obligations. Customer represents and warrants that all use of the Service is within the scope of Customer’s legal authority. Customer is solely responsible for all activity conducted through the Service, including any accounts accessed, communications sent or received, identity-related information configured, and the following:

  • Maintaining access to provisioned SMS and email accounts, including secure management of recovery email account credentials;
  • Using the Service in compliance with applicable law and regulation;
  • Ensuring compliance with data protection obligations relevant to Customer’s use (e.g., GDPR, HIPAA, or sector-specific rules);
  • Acknowledging that, in regard to email accounts provisioned in conjunction with this Service, Authentic8 provides provisioning only and no ongoing support, password resets, log reporting, or recovery services;
  • Not using provisioned email accounts to transmit unsolicited bulk communications, spam, or other abusive content.
  • Not using the Service for fraud, abusive activity, or any unlawful purpose, including impersonation of any real person or entity or obstruction of lawful investigations, except where expressly authorized by applicable law.

3. Data Handling & Privacy

3.1 SMS Messaging Data. To facilitate the provisioning, processing, and delivery of Short Message Service (“SMS”) communications as part of the Service, telephony systems used in connection with the Service may temporarily process and store certain information in plain text for a limited duration, typically less than twenty-four (24) hours.
Such information may include, without limitation: sender address (originating phone number), recipient address (destination phone number), message content, timestamps, message type, message length, message encoding, and message delivery status.

Customer acknowledges and agrees that SMS messaging relies on third-party telecommunications carriers and messaging infrastructure outside Authentic8’s control, and that such carriers and systems may process, transmit, or temporarily store the foregoing information as part of the ordinary operation of SMS delivery.

Notwithstanding any other provision of this Agreement, Customer acknowledges and agrees that Authentic8 shall bear no responsibility or liability for the processing, transmission, or temporary storage of such information by telephony systems or third-party carriers in connection with the Service, provided such processing or storage occurs in the ordinary course of SMS message delivery.

For the avoidance of doubt, Customer further acknowledges that SMS messaging is an inherently insecure communication method, and Customer assumes all risk associated with the receipt and use of SMS messages delivered through the Service.

3.2 Email Accounts and Email Data. Authentic8 does not monitor, access, retain, or review customer email content associated with the Service. Authentic8 does not provide email activity logs, message metadata, or reporting.

Any legal request, demand, or order seeking access to customer email content shall be redirected to the Customer, who acts as the data controller for all such content.

For clarity, Authentic8 is not the data controller or data processor of customer email content. Customer assumes full responsibility for compliance with applicable data protection, retention, and disclosure requirements related to email accounts provisioned in connection with the Service.

4. Service Availability. Authentic8 will use reasonable efforts to maintain Service availability. Disruptions caused by third-party carriers or email service providers are outside Authentic8’s control. The Service is provided “as is,” without warranties of any kind, including timeliness of SMS delivery, email account availability, or compatibility with third-party platforms. Authentic8 does not guarantee that the Service will be accepted by any third-party platform for authentication, verification, or account recovery purposes.

4.1 10-DLC Limitations and Third-Party Restrictions. Customer acknowledges and agrees that Third-Party Web Resources, carriers, or messaging platforms may block, restrict, or otherwise render ineffective any 10-digit long code (“10-DLC”) assigned to Customer, at their sole discretion and without notice.

Authentic8 makes no representations or warranties regarding the continued effectiveness, availability, or acceptance of any assigned 10-DLC for use with any Third-Party Web Resource, or that Customer will be able to retain or use any particular 10-DLC during the Subscription Term.

Authentic8 reserves the right, but does not undertake any obligation, to assign replacement 10-DLCs at its discretion. Authentic8 shall have no obligation to provide replacement 10-DLCs in the event that any assigned 10-DLC becomes restricted, blacklisted, or otherwise ineffective for accessing some or all Third-Party Web Resources.

5. Termination. Authentic8 may suspend or terminate access to the Service at its discretion, including where use introduces legal, regulatory, or reputational risk. 

Termination of a Customer’s Silo for Research subscription automatically terminates SMS Inbox and email account access.

6. Amendments. We may revise these Terms from time to time. Any changes will be posted at https://www.authentic8.com/terms/sms-inbox-terms-of-service/. Continued use of the Service constitutes acceptance of such changes.
